Early Saturday night, Tom Payne Green and Ben Abbott engaged in a fight on South main street, near Perdue & Son store, in which it was claimed that Green was beaten up by Abbott and that they afterward met in front of the Perdue property and, in attempting to make peace, engaged in another fight which resulted in the shooting of Abbott by Green, the bullet him near the heart, ranging downward and killing him instantly.
Green and Ernest Brewster, who accompanied him, were arrested and lodged in jail and was to be given an examining trial next Thursday.
Ben Abbott was a brother of Bluford Abbott, who was given a death sentence for a criminal attack, the sentence afterwards being commuted to life imprisonment by Governor Simpson.
Ben Abbott had recently been paroled from the reformatory for cutting Brewster, while Brewster had served a term for house breaking.
Green was pardoned by Governor Morrow some time ago for killing Didy Gibson. He was given a life sentence along with Jack Roberts and served seven years.
Abbott and Brewster were not married. Green is married and has several children.
